I. The story
The “CABVY” application, hereinafter called “the Application”, aims to facilitate interactions between Passengers wishing to use a Transport Vehicle with Driver (VTC) service and professional Drivers. The terms “Passengers” and “Drivers” are included in the “Specified Conditions” of “Users”.
The General Conditions of Use (CGU), available on the website www.cabvy.app or via a link at the bottom of the page, establish the terms of use of the Application.
These T&Cs may be supplemented or modified by specific conditions.
By accepting the T&Cs, the user benefits from a personal and non-commercial use license of the Application. The T&Cs apply to any use of the CABVY application or Website in France.
The services offered via the Application allow users to request services either directly from CABVY or through third-party providers. It is strongly recommended that you read the TOS carefully to understand user rights and other important guidelines.
By using the Application, you accept the terms and conditions of this agreement.
If you do not agree, please refrain from using the Application.

III. Conditions specified

CABVY Passenger Application: Refers to the mobile application software published by CABVY for passengers considering requesting a transport service.

CABVY Business Driver Application: Refers to the mobile application software specifically developed by CABVY for the use of drivers wishing to provide their transport services.

Drivers: Corresponds to independent transport operators, connected to Passengers via the Service, in charge of carrying out the required transport services.

Order: Constitutes the legal act by which a Passenger proceeds to the reservation of a transport service, an act which must be ratified by the Driver for its validation.

Account: Identifies all the identification and authentication elements provided by CABVY to a user, allowing access to a specific user interface within the Application.

General Conditions of Use (CGU): Designate the body of stipulations governing the use of the Service, prior acceptance required from Users using the CABVY application(s) for access and use of the Service.

CABVY: Refers to the legal entity, in the form of a simplified joint stock company, registered in the Paris trade and companies register, whose head office is located at 78 avenue des Champs-Élysées, 75008, Paris, France.

Passengers: Refers to natural or legal persons using the service with the aim of obtaining a connection with a Driver for the completion of a journey.

Payment provider: Refers to the third party entity authorized to provide solutions for processing online financial transactions between Users.

Price: Refers to the amount of money, expressed in euros, determined based on pre-established criteria such as pick-up location, distance traveled and travel time.

Service(s): Includes all the functionalities and services accessible via the CABVY mobile applications (Passenger and Driver).

Website: Refers to the electronic platform accessible at the URL www.cabvy.app, published by CABVY.

Price: Represents the financial quantification of the service, communicated in advance to the Passenger when placing the Order via the “CABVY” Passenger Application.

Journey: Refers to the transport operation carried out by the Driver, requested by the Passenger.

Users: Inclusive term referring to all categories of people using CABVY Services, including both Passengers and Drivers.

Services provided by CABVY: Refers to the services directly offered by CABVY, which may be governed by specific conditions distinct from these T&Cs.
IV. Regulations
1.1 These General Conditions (hereinafter referred to as the “Conditions”) define the legal framework governing the use of mobile applications and/or websites operated by CABVY. Before establishing a customer account via our digital platforms, prior reading and acceptance of these Conditions is required. Registering a customer account constitutes a sine qua non condition for requesting our services.
By agreeing to these Terms, you enter into a contract with CABVY, superseding any prior agreements or arrangements relating to the use of our Services.
1.2 These Terms apply unless otherwise provided by special terms of use relating to certain features of our digital platforms, which must be independently accepted.
1.3 CABVY establishes itself as a technological intermediary, facilitating the connection between passengers and professional drivers, and undertakes to ensure the connection in accordance with subsequent stipulations.
2. Description of Services via Applications/Websites
2.1 CABVY offers you the following services :
2.1.1 Access and use of its mobile applications and/or websites, allowing you to request and benefit from services to put you in touch with drivers;
2.1.2 Payment collection and processing services, aimed at simplifying your financial transactions with drivers.
2.2 These Conditions govern your use of our services on French territory.
2.3 Our applications and websites are offered under the “CABVY” brand.
2.4 Unless otherwise agreed in writing, our services are provided to you exclusively for personal, non-commercial use.
2.5 Our digital platforms allow you to request and obtain connection services with VTC drivers.
3. Services Provided by Third Parties
3.1 As part of the connection, CABVY operates as a technological intermediation platform between Passengers and Drivers, without directly providing transport services. VTC drivers operate as independent contractors and are not employees of CABVY.
3.2 When requesting a service, information concerning the VTC drivers available nearby is communicated to you in advance.
3.3 VTC drivers have the freedom to accept or refuse a service request.
3.4 For some specific services, acceptance of separate terms and conditions may be required.
3.5 You are given the opportunity to evaluate the VTC driver at the end of each trip, and vice versa. These evaluations can influence the quality of future services.
4. Terms of Use of the Applications
4.1 Our platforms are designed to be compatible with the majority of modern mobile devices connected to the Internet.
4.2 You are responsible for securing access to the network necessary for the use of our services, all related costs being your responsibility.
4.3 Registration and creation of an account are essential for the use of our services. You must be at least eighteen (18) years old to register.
4.4 Registration requires the provision of certain personal data and, where applicable, a valid means of payment.
4.5 You have the right to stop using our applications or websites at any time, without prior notification.
4.6 In the event of a significant violation of your obligations, restricted access to our services may be temporarily imposed on you, with communication relating to this restriction and its possible lifting.
V. Canceling a trip
5.1 Cancellation without charge, the passenger has the possibility to cancel their reservation before confirmation of pick-up.
5.2 Passenger cancellation impossible in two situations :
• If the cancellation occurs after confirmation of support.
• If the passenger, or any other person for whom transport has been booked, does not show up at the meeting point with the vehicle.
5.3 Cancellation by the Driver, the driver has the discretion to cancel the passenger's pick-up for various reasons, including:
Failure to present the Passenger at the meeting point;
Transporting a large animal without appropriate equipment;
Any danger likely to compromise the safety of the driver or vehicle;
A transport request exceeding the capacity of the vehicle;
The absence of equipment required for transporting children (such as a car seat);
Exceptional or unforeseeable circumstances;
For any other legal reason.
It should be noted that although the driver is informed of the price and the destination before accepting a trip, the driver must ensure profitability and all other reasons not mentioned, he does not retain the right to cancel certain requests. if he considers that the journey is not profitable.
VI. Commitments required
6.1 When using CABVY services, you are required to comply with all applicable laws. You are expected to use our services ethically, honestly and in accordance with their original purpose. Any abusive or fraudulent use of CABVY services is strictly prohibited.
6.2 Please ensure that you provide accurate information when registering and in any interaction with the CABVY Services.
6.3 Your CABVY account is personal and cannot be transferred or shared without our prior consent.
After your registration:
Limit yourself to a single account, unless we specifically agree to this;
Be sure to secure access to your account and do not entrust it to third parties;
Update your information regularly;
Keep your password confidential;
Notify us immediately if there is any suspicious activity on your account.
6.4 You are financially responsible for all activities carried out through your account, unless they are the result of negligence on our part. In the event of financial fraud, please contact us and your financial institution immediately.
6.5 Ensure that your use of CABVY services does not cause inconvenience or harm to CABVY, its partners or other users. When a passenger has confirmed a trip reservation and a driver has accepted it, the passenger is required to present themselves at the indicated departure location.
In the event of cancellation for any reason, the passenger undertakes to promptly inform the driver and CABVY by the most appropriate means.
The passenger must pay the agreed rate to the driver via CABVY in accordance with the terms previously defined. In the event of a dispute or refusal of payment, the passenger will not be able to access the journey.
VII. Pricing policy
7.1 Trip Pricing Through its application, CABVY offers an estimated price (hereinafter referred to as the “Estimated Price”) for completing the requested journey.
Before accepting this Estimated Price, the passenger must check and confirm that all the information displayed corresponds to their planned journey.
CABVY communicates to the passenger the estimated price in advance via the application, taking into consideration elements such as the starting point, the destination (allowing the duration and distance of the journey to be estimated) as well as the current demand .
Once the passenger validates this estimated price, the trip details are shared with different drivers, allowing them to view the trip information, including the starting point, destination and estimated price.
A driver who accepts the ride has the freedom to choose the route he deems most appropriate, subject to the passenger's approval.
It should be noted that the estimated price is fixed in advance and does not vary depending on the route actually taken during the journey.
The only exception could arise if there is an unforeseen event that significantly extends travel time (e.g. a road closure due to unplanned works). In such a situation, the price of the journey is indifferent, while maintaining the initially planned distance.
7.2 Fees related to Third Party Services and CABVY Special Offers
7.2.1 By initiating a transaction via the CABVY App, you agree to pay all associated fees as detailed in section 7.1 above.
7.2.2 The total amount of charges may be indicated before confirmation of your order, depending on the service chosen. Otherwise, the amount will be based on specific criteria detailed when selecting the service.
7.2.3 After the service has been provided, an invoice may be sent to you directly or via the service provider concerned, including all applicable taxes.
7.3 General Provisions
7.3.1 Prices are subject to change and any changes will be communicated with your prior agreement. If you refuse these changes, you may be restricted in your use of the CABVY Services.
7.3.2 Prices do not include tips. If you would like to leave a tip, this can be done directly or through our platform.
7.3.3 Unless otherwise stated, all charges are due immediately upon confirmation of your order. Payment is facilitated by CABVY with the payment method associated with your account. In the event of payment failure, CABVY reserves the right to retry the transaction and no other means of payment is authorized by CABVY, only payments in Apple Pay and Google Pay are authorized from our CABVY platforms.
7.3.4 All prices are inclusive of tax. Payment of the price by Apple Pay and Google Pay is managed by the secure payment provider, which only stores users' credit card information for this purpose.
VIII. Terms of cancelation
CABVY Users have the right to cancel their reservation free of charge, and only before confirmation of pick-up. This provision respects our commitments in terms of flexibility and transparency. We thus guarantee our users simplified management of their reservations, in accordance with our service standards.
IX. Innovation rights
CABVY holds all intellectual property rights over its products, services, brands, logos, creative content and any distinctive element associated with its activity. These rights are protected by national and international intellectual property laws, including copyright, trademark and related rights. Any unauthorized use of these materials is strictly prohibited and may result in legal action. CABVY reserves the right to fully apply its intellectual property rights to preserve its commercial identity and creative heritage.
X. Privacy Guarantee
CABVY attaches great importance to the protection of the personal data of its users, being fully committed to complying with applicable laws and regulations relating to data privacy, including the European Regulation (EU). We implement rigorous measures to guarantee the confidentiality, security and integrity of the personal data collected.
Our Privacy Policy governs the collection, use and protection of personal information.
By using our Platforms, users unequivocally consent to the collection and use of their information in accordance with the Privacy Policy.
XI. Termination policy
Users of the CABVY application, passengers or drivers, can cancel their account at any time directly from the application. We remind drivers that when canceling their account, they must first withdraw all available income in their balance, as this action is irreversible. Termination of the account implies cessation of access to the services offered by CABVY.
XII. Revised rules
By using the services offered by CABVY, you expressly acknowledge and agree to be irrevocably bound by the following terms and conditions. Please note that these terms and conditions are subject to change which may occur at any time. We therefore recommend that you regularly inform yourself of any updates by consulting the latest versions of the terms and conditions available on the website www.cabvy.app.
By using the CABVY application(s), you unequivocally affirm that you have carefully read, understood and freely accepted all the provisions of this Agreement.
CABVY reserves the absolute right to modify or modify this agreement at any time, and such modifications will be duly communicated to you through our applications. Your continued use of the “CABVY” or “CABVY Business” application after modification will constitute your unequivocal acceptance of the revised agreement.
XIII. Litigation
In the event of conflicts or disagreements, we are firmly committed to seeking an amicable resolution in order to achieve a peaceful and fair settlement. However, if no agreement is reached, the file will be sent to a specialist in legal matters for examination and appropriate management.
XIV. Confidentiality
The collection and processing of personal data by the Company will be carried out in strict compliance with its Privacy Policy. Your use of the applications constitutes your unequivocal consent to the collection and use of your personal information by the Company, as described in the Privacy Policy.
XV. User conduct
Users subscribe to the firm commitment to respect the following conditions:
They expressly renounce using the Application for illicit or fraudulent purposes.
They undertake not to engage in harassment, stalking or any other harmful behavior towards other users or VTC drivers.
They recognize the absolute prohibition of disrupting or hindering the proper functioning of the Application. They are required to refrain from any commercial use of the Application without first obtaining the written consent of the Company.
These provisions are put in place to guarantee an environment for using the Application that complies with legal and ethical standards. Any failure to comply with these commitments may result in the permanent suspension of the user account, in order to preserve the integrity and security of the platform for all of its users and VTC drivers.
XVI. Limitation of liability
CABVY disclaims any liability for indirect, incidental, special, consequential or punitive damages arising from the use of its applications. This clause aims to clarify that the company assumes no liability for unforeseen or indirect damage, such as loss of profits, loss of data or immaterial damage, which could result from the use of the applications. It also aims to protect the company against any claims of a punitive or consequential nature related to the use of its applications.
XVII. Commission and withdrawal
CABVY ne perçoit aucun frais de commission sur les trajets pour tous les utilisateurs. Cependant, les chauffeurs sont tenus de payer des frais bancaires de cinq euros (5€) TTC à chaque demande de retrait effectuée et un solde de minimum de dix euros (10€) est imposé afin de recevoir leurs revenus dans un délai de 7 jours ouvrables. Ces frais bancaires couvrent les coûts associés au traitement des paiements et à la gestion des comptes des chauffeurs, garantissant ainsi une gestion efficace des transactions financières sur la plateforme CABVY.
XVIII. Monthly access
CABVY offers its drivers a flexible and transparent payment model. This model starts from the first access to the services, without commitment. It consists of a recurring payment cycle fixed at fifty euros (€50) including tax every month. This cycle, without time limit, resets automatically once the month of the date previously paid two fifty euros (€50 including tax) , leaving you with fifty euros (€50 including tax) for the following month. This approach ensures drivers have continued access to CABVY features, while ensuring clear and predictable financial management.
XIX. Infinity
Under the terms and conditions governing the use of the CABVY application, we inform Passengers of an applicable discount program.
In accordance with this program, each three races carried out via the application automatically activates a reduction of fifteen percent (15%) for the next race to be activated via a coupon.
This reduction is automatically applied to the next reservation.
It is important to note that this reduction cannot be combined and can only be used once.
After use, the discount counter is reset, requiring five new runs to activate a new discount.
This reduction system is established for an indefinite period, with the aim of rewarding the loyalty of users of the application.
XX. User behavior
Compliance with Laws: All users are responsible for complying with all applicable laws and regulations when using the Platform, including, but not limited to, local, state, and national transportation laws .
Discrimination: Discriminatory or biased practices based on race, religion, gender, sexual orientation or other protected category.
Harassment : Harassment, threats or any form of harm directed against other users or third parties.
Fraud : Participation in fraudulent activities, including payment fraud or identity theft.
Unauthorized Access : Attempt to access, use or interfere with the Platform's systems, data or networks without proper authorization.
XXI. Termination

Termination by CABVY: CABVY reserves the unquestionable right to unilaterally terminate or suspend the user's access to the Platform at any time in the event of violation of these Terms or applicable laws.

Termination by User: Users may voluntarily delete their accounts at their discretion by following the procedures provided on the Platform.
XXII. Changes to Terms
CABVY reserves the right to modify these Terms at its sole discretion. Any modification will be effective upon publication on the Platform. Continued use of the Platform after such modifications signifies the user's acceptance of the modified Terms.
XXIII. Paiements

Payment methods : By using the services of the company CABVY, Users acknowledge that the only payment methods accepted are Apple Pay and Google Pay. To ensure the security of transactions and the protection of users, no cash or other payment methods are permitted. Users are therefore required to provide valid payment information, compatible with the aforementioned methods. By accepting these conditions, Users undertake without reservation to assume all costs and expenses associated with their use of the Platform.
Fees : Users may be subject to fees for transportation services obtained through our Platforms, the details of which are specified in the applications and subject to change, without any hidden charges.

As part of our legal consent policy, we inform our users that the use of our mobile applications "CABVY" and "CABVY Business" automatically implies acceptance of the legal and confidentiality conditions stipulated therein. This acceptance is necessary to access our services. We ensure that these conditions are clear, accessible and comply with current data protection legislation. Any user with reservations regarding these conditions is requested to refrain from using our services. At CABVY, we value transparency and respect for our users' choices regarding legal consent.
XXVI. Coming into force
The provisions of these terms and conditions are in force since March 10, 2024.
